Article 28. Invalid ballots when summing up the results of the Republican referendum Constitutional Law a On the Republican Referendum

     1. The following ballots are considered invalid when summarizing the results of the referendum::

     1) Unidentified sample;

     2) in which there is no signature of a member of the precinct referendum commission;

     3) in which none of the possible answers to the question submitted to the referendum is marked.;

     4) in which the mark is marked with a pencil, bears traces of erasure or other method of forgery, as well as in which it is impossible to determine the will of the voters.

     2. Ballots containing all possible answers to the question put to the referendum are considered valid, but are not taken into account when counting votes.

     3. If there is a disagreement about the invalidation of ballots when summarizing the results of the referendum, the issue is resolved by the precinct referendum commission by voting. In this case, the decision is made by at least two thirds of the votes of the total number of members of the commission.

     This Constitutional Law, in accordance with the Constitution of the Republic of Kazakhstan, determines the procedure for the appointment, preparation and conduct of a republican referendum.
