Article 21. Powers of the Central Referendum Commission Constitutional Law a On the Republican Referendum

     1. The Central Commission of the Referendum:

     1) exercises control over the implementation of legislation on referendums throughout the territory of the Republic, ensures its uniform application; makes decisions within its competence that are binding throughout the territory of the Republic;

     2) organizes the preparation and conduct of the referendum;

     3) draws up and submits to the Government of the Republic a draft cost estimate for the organization and conduct of the referendum;

     4) manages the referendum commissions, cancels and suspends their decisions; distributes funds among them for the organization and conduct of the referendum;

     5) monitors the state of logistical support for the referendum commissions;

     6) considers applications and complaints about violations of the legislation on the referendum;

     7) establishes the forms and texts of voting ballots, voter lists, signature lists, and other documents necessary for holding a referendum; the time of voting; and the procedure for storing referendum documents;

     8) has the right to hear reports from the referendum commission, state bodies and their officials on issues related to the preparation and conduct of the referendum, as well as information from public associations on compliance with election legislation;

     9) informs citizens about the preparation of the referendum;

     10) summarizes the results of the referendum in the Republic as a whole, ensures the transmission of information about it in the mass media;

     11) carries out registration of the referendum initiative group and the question(s) proposed by it for the referendum, and posts an official notice about it in the mass media;

     12) approves the form of the certificate of registration of the referendum initiative group;

     13) issues a certificate of registration of the referendum initiative group simultaneously with the issuance of signature lists;

     14) decides on the termination of the activities of the members of the initiative group, the activities of the initiative group and the revocation of the certificate of its registration in the cases provided for by this Constitutional Law.;

     15) recognizes the holding of a referendum in certain polling stations (administrative-territorial units) as invalid in the cases provided for by this Constitutional Law.

     2. Meetings of the Central Referendum Commission are valid if at least two thirds of the total number of its members are present.

     3. The Central Referendum Commission makes its decisions by a majority vote of the total number of its members.<*>

 

Constitutional Law of the Republic of Kazakhstan dated November 2, 1995 No. 2592.

     This Constitutional Law, in accordance with the Constitution of the Republic of Kazakhstan, determines the procedure for the appointment, preparation and conduct of a republican referendum.
