Article 152. Violation of the labor legislation of the Republic of Kazakhstan The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

Article 152. Violation of the labor legislation of the Republic of Kazakhstan  The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1 Illegal termination of an employment contract with an employee or failure to comply with a court decision on reinstatement at work, as well as other violation of the labor legislation of the Republic of Kazakhstan, resulting in significant harm to the rights and legitimate interests of a citizen, –

     are punishable by community service for up to one hundred and sixty hours or by arrest for up to forty days, with or without deprivation of the right to hold certain positions or engage in certain activities for up to one year.

2 Unjustified refusal to conclude an employment contract with a woman or unjustified termination of an employment contract with her on the grounds of her pregnancy, or unjustified refusal to conclude an employment contract, or unjustified termination of an employment contract with a woman with children under three years of age on these grounds, as well as unjustified refusal to conclude an employment contract or unjustified termination of an employment contract with a person with a disability on the grounds of disability or a minor on the grounds of his minor –

     are punishable by a fine in the amount of up to two hundred monthly calculation indices or correctional labor in the same amount, or community service for up to two hundred hours, or arrest for up to fifty days, with or without deprivation of the right to hold certain positions or engage in certain activities for up to one year.

3 Repeated delay by a person performing managerial functions in the payment of wages in full and on time due to the use of money for other purposes –

     is punishable by a fine in the amount of up to two hundred monthly calculation indices or correctional labor in the same amount, or community service for up to two hundred hours, or arrest for up to fifty days, with or without deprivation of the right to hold certain positions or engage in certain activities for up to three years.
