Article 208. Calculation of the length of service for the appointment of pension payments according to the age of the Social Code of the Republic of Kazakhstan
1. When calculating the length of service, pension payments based on age are counted:
1) work under employment contracts, paid for by individuals and legal entities;
2) military service;
3) service in special state and law enforcement agencies, civil protection agencies, state courier service;
4) Public service;
5) entrepreneurial and other income-generating activities;
6) the time of caring for a person with a disability of the first group, a single person with a disability of the second group and a pensioner in need of outside help, as well as the elderly who have reached the age of eighty;
7) the time of caring for a child with a disability under the age of 18;
8) the time of a non-working mother's care for young children, but not more than until each child reaches the age of 3 years, within 12 years in total;
9) the time of detention, serving sentences in places of deprivation of liberty and exile of citizens who were unreasonably prosecuted and repressed, but subsequently rehabilitated;
10) the time spent by able-bodied citizens in the temporarily occupied territory of the former USSR and persons (regardless of age) on the territory of other states during the Great Patriotic War, where they were forcibly removed, held in Nazi concentration camps (ghettos and other places of forced detention during the war), if these persons did not commit crimes during these periods. against the Motherland;
11) the time spent on disability by non-working persons with disabilities due to injury, contusion, injury or illness sustained during the Great Patriotic War, and persons with disabilities equated to them;
12) the period of residence abroad of the spouse of employees of former Soviet institutions, institutions of the Republic of Kazakhstan and international organizations, but not more than 10 years in total;
13) the period of residence of spouses of military personnel (except for conscripts), employees of special government agencies with their spouses in areas where there was no possibility of their employment in their specialty, but not more than 10 years in total;
14) education in higher educational institutions, including preparatory courses, secondary specialized educational institutions, colleges, schools and training courses, advanced training and retraining, postgraduate, doctoral and clinical residency, as well as spiritual (religious) educational organizations in the Republic of Kazakhstan and abroad;
15) service in paramilitary security, special communications and mountain rescue units, regardless of departmental subordination and the presence of a special or military rank;
16) labor activity in the country of departure of ethnic Kazakhs who arrived in the Republic of Kazakhstan for permanent residence in their historical homeland.
2. In case of preferential calculation of work experience, age-related pension payments are also counted:
1) military service in the active army during the period of hostilities, including during the performance of military duty, as well as stay in partisan detachments and formations during the period of hostilities, as well as time spent being treated in medical institutions as a result of a military injury – in accordance with the procedure established for calculating the terms of this service when assigning pension payments for service to military personnel;
2) work, including as a volunteer in military units, and service, except for military service provided for in subparagraph 1) of this paragraph, during the Great Patriotic War – in double the amount;
3) work in the city of Leningrad during its blockade during the Great Patriotic War from September 8, 1941 to January 27, 1944 – in a triple amount;
4) the time spent by citizens aged 12 and over in the city of Leningrad during the period of its blockade from September 8, 1941 to January 27, 1944 – in double the amount;
5) the time spent by persons on the territory of other states during the Great Patriotic War, where they were forcibly removed, as well as the time spent in Nazi concentration camps (ghettos and other places of forced detention during the war), if during these periods these persons did not commit crimes against the Motherland, – in double the amount;
6) the time spent in custody, serving sentences in places of deprivation of liberty, exile, forced labor with restriction of freedom, in a penal colony and on compulsory treatment in an organization providing medical care in the field of mental health, citizens unlawfully prosecuted and repressed, subsequently rehabilitated - in a triple amount;
7) work and military service in the areas adjacent to the Semipalatinsk nuclear test site in the period from August 29, 1949 to July 5, 1963 – in a triple amount, and from July 6, 1963 to January 1, 1992 – in one and a half times;
8) work in leprosy and anti–plague institutions, infectious institutions for the treatment of persons infected with the human immunodeficiency virus or AIDS patients - in double the amount, in organizations carrying out forensic medical examination and pathoanatomic diagnostics – according to the list of works approved by the Government of the Republic of Kazakhstan – one and a half times;
9) work on water transport during the full navigation period is counted for the year of work;
10) work during the full season in organizations of seasonal industries, regardless of their departmental subordination – according to the list approved by the Government of the Republic of Kazakhstan, is counted in the length of service for the year of work.
