Article 58. Grounds for termination of the employment contract in case of employee's refusal to continue the employment relationship of the Labor Code of the Republic of Kazakhstan

1. An employment contract with an employee is subject to termination if the employee refuses to continue the employment relationship in the following cases::

1) the employee's refusal to transfer to another locality together with the employer;

2) the employee's refusal to continue working due to changes in working conditions;

3) refusal of the employee from temporary transfer to another job for health reasons when he receives an occupational injury, occupational disease or other damage to health not related to production in connection with the performance of work duties.

2. Termination of an employment contract is allowed if the employee refuses in writing to continue the employment relationship or if there is an act certifying the employee's refusal to submit a written refusal to continue the employment relationship.

3. Termination of an employment contract on the grounds specified in paragraph 1 of this article is not allowed during the period of temporary disability of the employee (including for pregnancy and childbirth) and vacation.
