Article 214. Calculation of length of service and total length of service of the Social Code of the Republic of Kazakhstan

    The calculation of seniority for military personnel, employees of special state and law enforcement agencies, civil protection agencies, state paramedic service, as well as persons whose rights to have special ranks, class ranks and wear uniforms have been abolished since January 1, 2012, and persons whose medical positions have been reduced in the internal affairs bodies of the Republic of Kazakhstan since July 1, 2022 on January 1, 2023, who had at least twelve years and six months of continuous military service at the time of the reduction of the position., services in special state and law enforcement agencies, civil protection agencies, and the state courier service, provided that they continue to work in medical organizations located in pre-trial detention facilities and institutions of the penal enforcement (penitentiary) system, are performed in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

     At the same time, the length of service for the appointment of pension payments for years of service is calculated on a calendar basis, with the exception of cases established by the legislation of the Republic of Kazakhstan.

     The length of service calculated in a member State of the Commonwealth of Independent States is not subject to revision, unless otherwise provided for by international treaties ratified by the Republic of Kazakhstan.

     The calculation of the total length of service for military personnel, employees of special state and law enforcement agencies, civil protection agencies, state paramedic service, as well as persons whose rights to have special ranks, class ranks and wear uniforms have been abolished since January 1, 2012, is carried out in the same way as the calculation of length of service for age pension payments in accordance with Article 208. of this Code.
