Article 36. Rights and obligations of a member of the public monitoring commission of the Penal Enforcement Code of the Republic of Kazakhstan
1. A member of the public supervisory commission may:
1) in accordance with the procedure established by this Code, as part of a formed group, visit institutions and bodies executing punishments;
2) to meet with officials of institutions and bodies executing punishments, to receive information from them on issues related to the activities of the public monitoring commission;
3) subject to the provisions of part three of Article 38 of this Code, to conduct interviews with convicts held in institutions and bodies executing punishments, without witnesses, in person or, if necessary, through an interpreter, to accept appeals regarding violations of their rights, freedoms and legitimate interests.;
4) with the written consent of the convicted person, get acquainted with the materials related to his appeal;
5) to address issues related to ensuring the rights, freedoms and legitimate interests of convicts held in institutions and bodies executing punishments to their administration, higher authorities, prosecutor's offices;
6) participate in court sessions when considering issues related to the field of activity of the public monitoring commission;
7) inform the administration of the institution or body executing the punishment in writing about the results of its activities. If the institution or body executing the punishment fails to eliminate the identified deficiencies, report them to their higher authorities and (or) the prosecutor's office.;
8) in coordination with the prosecutor's office, participate in their inspections of the activities of institutions or bodies executing punishment.
2. In exercising their powers, members of the public monitoring commission are required to comply with the requirements of regulatory legal acts that ensure the activities of institutions and bodies executing punishment, and to comply with the legitimate requirements of their administration.
3. If there are circumstances that cast doubt on the impartiality of a member of the public monitoring commission who is part of a group to visit an institution or body executing a sentence, he is obliged to refuse to participate in it.
