Article 612. Early termination of the contract of the Civil Code of the Republic of Kazakhstan

     1. The lender has the right to demand early termination of the contract of gratuitous use in cases when the lender:

     1) uses the property not in accordance with the contract or the purpose of the property;

     2) does not perform the duties of maintaining the property in good condition or its maintenance;

     3) significantly worsens the condition of the property;

     4) transferred the property to a third party without the consent of the lender.

     2. The borrower has the right to demand early termination of the contract of gratuitous use:

     1) if there are deficiencies that make the normal use of the property impossible or burdensome, the existence of which he did not know and could not have known at the time of the conclusion of the contract;

     2) if the property, due to circumstances for which he is not responsible, turns out to be in a condition unsuitable for use.;

     3) if, at the conclusion of the agreement, the lender did not warn him about the rights of third parties to the transferred property.;

     4) if the lender fails to fulfill the obligation to transfer the property or its accessories and related documents.
