On the establishment of the Armed Forces of the Republic of Kazakhstan
Decree of the President of the Republic of Kazakhstan dated May 7, 1992 No. 745
Guided by the Constitutional Law of the Republic of Kazakhstan "On the State Independence of the Republic of Kazakhstan", proceeding from the need to implement a unified state policy in the field of defense, based on the legitimate right to create its own Armed Forces, confirmed in the Agreement of the Council of Heads of State of the Commonwealth of Independent States on the Armed Forces and Border Troops, and taking into account the formation of its own Armed Forces by other States of the Commonwealth, I DECREE:
1. Create the Armed Forces of the Republic of Kazakhstan.
Military formations, formations, units, institutions, organizations, ranges, arsenals, storage bases, warehouses, movable and immovable military property of the United Armed Forces of the Commonwealth stationed in the territory of the Republic of Kazakhstan shall be transferred to the jurisdiction of the Republic of Kazakhstan and incorporated into the Armed Forces of the Republic of Kazakhstan in compliance with the terms of the Agreements on the United Armed Forces of the Commonwealth of Independent States.
2. For all military formations stationed on the territory of the Republic of Kazakhstan armed with nuclear weapons, for the period until their complete elimination, maintain the existing Strategic Force management system in accordance with previously adopted Agreements between the member States of the Commonwealth.
3. The leadership of the Armed Forces of the Republic of Kazakhstan, until the adoption of the necessary legislative acts, is carried out by the President of the Republic of Kazakhstan, the Supreme Commander-in-Chief, and direct management is entrusted to the Minister of Defense of the Republic of Kazakhstan.
4. The Ministry of Defense of the Republic of Kazakhstan, within a 3-month period, shall receive military formations, formations, units, institutions and organizations of the United Armed Forces of the Commonwealth stationed in the territory of the Republic of Kazakhstan, ensure the creation of a system of direct command of troops, organize interaction with the Commander-in-Chief of the United Armed Forces and take measures to maintain their combat readiness.
Prohibit the command of military formations, formations, units, institutions, organizations, ranges, arsenals, storage bases and warehouses, including those directly subordinate to the Commander-in-Chief of the United Armed Forces, their redeployment, as well as the export of military equipment, weapons and logistical property outside the Republic of Kazakhstan without the approval of the Government.
5. The Cabinet of Ministers of the Republic of Kazakhstan shall resolve the issues of financing, food, logistical and medical support for troops stationed in the territory of the Republic of Kazakhstan.
6. Extend the existing legal norms, instructions and regulations governing the vital activity of troops and the maintenance of their combat readiness for the period until the adoption of relevant acts of the Republic of Kazakhstan.
