Article 52. The right of the Hydrographic Support Service of the Naval Forces of the Armed Forces of the Republic of Kazakhstan and the Maritime Administration of the port to full reimbursement of expenses incurred The Merchant Shipping Act

Article 52. The right of the Hydrographic Support Service of the Naval Forces of the Armed Forces of the Republic of Kazakhstan and the Maritime Administration of the port to full reimbursement of expenses incurred The Merchant Shipping Act

     1. The following persons are entitled to full reimbursement of expenses incurred:

     1) The Hydrographic Support Service of the Naval Forces of the Armed Forces of the Republic of Kazakhstan – for expenses incurred in locating and marking sunken property with navigation signs;

     2) the maritime administration of the port – for expenses incurred in connection with the removal of sunken property carried out in accordance with paragraph 1 of Article 51 of this Law.

     2. Reimbursement of incurred expenses is carried out at the expense of:

     1) the amount earned from the sale of the remote sunken property, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, the remaining amount is transferred to the owner of the sunken property.;

     2) the owner of the sunken property in the event that the amount earned from the sale of the sunken property does not cover the costs incurred for locating, marking the sunken property and its removal.

     The funds received from reimbursement of expenses incurred are credited to the State income.

     This Law defines the legal, organizational, economic and international foundations of public administration in the field of merchant shipping and regulates relations related to the transportation of passengers, baggage and cargo, ensuring safety in maritime transport and environmental protection.
