On approval of the general military regulations of the Armed Forces, other troops and military formations of the Republic of Kazakhstan

     In accordance with the Law of the Republic "On Defense and the Armed Forces of the Republic of Kazakhstan", I HEREBY DECREE:

     The footnote. The preamble is in the wording of the Decree of the President of the Republic of Kazakhstan dated October 28, 2025 No. 1068 (effective ten calendar days after the date of its first official publication).

     1. Approve the attached general military regulations:

     1) the charter of the internal service of the Armed Forces, other troops and military formations of the Republic of Kazakhstan;

     2) the charter of the garrison and guard services of the Armed Forces, other troops and military formations of the Republic of Kazakhstan;

     3) combat regulations of the Armed Forces, other troops and military formations of the Republic of Kazakhstan;

     4) the disciplinary regulations of the Armed Forces, other troops and military formations of the Republic of Kazakhstan.

     2. The Ministry of Defense of the Republic of Kazakhstan, the Ministry of Internal Affairs of the Republic of Kazakhstan, the Ministry of Emergency Situations of the Republic of Kazakhstan, the National Security Committee of the Republic of Kazakhstan, the State Security Service of the Republic of Kazakhstan, the Prosecutor General's Office of the Republic of Kazakhstan, when planning and organizing the daily activities of subordinate troops and military formations, should be guided by the general military regulations of the Armed Forces, other troops and military formations of the Republic of Kazakhstan.

     3. To invalidate the Decree of the President of the Republic of Kazakhstan dated November 27, 1998 No. 4156 "On approval of the Charters of the Armed Forces of the Republic of Kazakhstan".

     4. This Decree shall enter into force from the date of its first official publication.

The CHARTER OF the INTERNAL SERVICE of the Armed Forces, other troops and military formations of the Republic of Kazakhstan

     The footnote. The Charter as amended by Decree of the President of the Republic of Kazakhstan dated 02.02.2016 No. 187 (effective ten calendar days after the date of its first official publication).

     This Charter defines the main provisions of the internal order, the general rights, duties of military personnel and the relationship between them, the duties of key officials and persons on daily duty.

     The duties of officials not specified in this Charter are determined by the relevant instructions, rules, regulations and other regulatory legal acts.

     The Charter of the Internal service of the Armed Forces, other Troops and Military Formations of the Republic of Kazakhstan (hereinafter referred to as the Charter of the Internal Service) applies to military personnel of the Armed Forces, other troops and military formations of the Republic of Kazakhstan (hereinafter referred to as the Armed Forces), as well as to citizens during their military training, citizens discharged from military service with the right wearing military uniforms, while wearing them.

General provisions

     1. The protection of the Republic of Kazakhstan is the sacred duty and duty of every citizen of the Republic.

     Citizens of the Republic of Kazakhstan perform military service in accordance with the procedure and types established by law.

     Military service is an expression of special trust on the part of society and the state, and places high demands on the morals and moral and ethical image of military personnel.

     Citizens of the Republic of Kazakhstan undergo conscription or voluntarily enter military service under a contract or military service in the reserve in accordance with the Rules of military service in the Armed Forces, other troops and military formations of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated May 25, 2006 No. 124 (hereinafter – the Rules of Military Service), taking into account the specifics established by law.

     In accordance with the Law of the Republic of Kazakhstan "On Military Service and the Status of military Personnel", the military ranks specified in Appendix 1 to the Internal Service Charter are established in the Armed Forces.

     2. The status of a serviceman includes the general rights, freedoms and duties of a serviceman as a citizen of the Republic of Kazakhstan with exceptions and restrictions established by law, as well as his rights, duties and responsibilities due to the specifics of military service.

     In order to verify their status, military personnel are issued tokens with personal numbers, military identification cards (military ID cards) and (or) service certificates in accordance with the procedure established by the authorized body.

     3. According to the legislation, the content and scope of the rights, duties and responsibilities of military personnel depend on whether they are performing military service (official duties) or not.

     A serviceman, as well as a citizen who is in reserve, during military training, during the period of military training, is in the performance of military service duties in the following cases:

     1) performance of official duties;

     2) participation in hostilities, performing tasks in conditions of emergency or martial law, as well as in conditions of armed conflict;

     3) participation in peacekeeping operations to maintain peace and security;

     4) participation in anti-terrorist operations;

     5) participation in the liquidation of emergency situations;

     6) field trips (sea trips), participation in exercises or ship trips;

     7) being on the territory of a military unit during the official time established by the daily routine or at other times if it is caused by official necessity.;

     8) being on a business trip;

     9) going to the place of service and back;

     10) being treated, going to the place of treatment and back;

     11) passing military training;

     12) being in captivity, in the position of a hostage or internee;

     13) providing assistance to law enforcement agencies for the protection of human and civil rights and freedoms, law enforcement and public safety;

     14) being in an active reserve;

     15) being on advanced training, retraining, retraining, study, military internship;

     16) conducting research, being on military and other tests.

     The status of conscripted military officers is determined by the status of military personnel undergoing military service under contract (hereinafter referred to as contract military personnel).

     A conscript serviceman is in the performance of military service duties during the entire period of military service, and a conscript is in military service during the entire period of military training. A serviceman serving in the military reserve (hereinafter referred to as a military reservist) is in the performance of military service duties during periods of stay in a military unit (institution) at classes or training camps for combat training, as well as crisis training camps.

     Military personnel in the performance of military service (official duties) are representatives of the civil service and are under the protection of the State.

     4. Military service is a set of measures aimed at ensuring high combat readiness in garrisons, military units and subunits, the statutory military order, discipline and compliance with the rules established by laws, general military regulations of the Armed Forces (hereinafter referred to as general military regulations), orders, instructions regulating the life, lifestyle, activities of troops, as well as organization of daily service in peacetime and wartime.

     This complex includes:

     1) internal service, which determines the daily official activities in military units, subunits, parks, training centers, training grounds and camps, on ships, institutions, ensuring the maintenance of combat readiness, internal order, living conditions, way of life and education of military personnel, the correct storage and issue of weapons and ammunition;

     2) daily duty service designed to maintain internal order, protect personnel, weapons and military equipment, missiles and ammunition, premises, property and other material assets of a military unit (subdivision), monitor the state of affairs in the units and timely take measures to prevent and prevent violations of military discipline, daily routine and the rules of official time, as well as for the performance of other duties;

     3) garrison service, which aims to ensure the maintenance of combat readiness, high military discipline of the garrison personnel, the necessary conditions for daily activities and training of troops, and the conduct of garrison activities.

5. The internal service in a military unit is managed by the commander of the military unit, and in the unit by the commander of the unit. When several units are located in the same room, the commanders of which do not have a common direct superior, by order of the commander of the military unit (head of the garrison), the management of the internal service is assigned to the commander of one of these units. The direct organizer of the internal service in a military unit is the chief of staff of the military unit, and in the location of the unit is the commander of the unit (chief of staff).

     Military unit commanders are understood to mean the commanders (chiefs) of brigades, bases, detachments, regiments, centers, ships of the 1st, 2nd, and 3rd ranks, individual battalions, divisions, commandant's offices, squadrons, individual companies, heads of republican government agencies, military educational institutions, and other military units that are organizationally independent units of the Armed Forces.

     Unit commanders are understood to be the commanders at the unit level - a line battalion and their equals.

     Responsibility for the state of internal service in subordinate troops is assigned to all direct superiors. They are required to assist subordinate military units and subunits in organizing and ensuring compliance with the requirements of the internal service and systematically check its condition.

     A military unit (institution) (hereinafter referred to as a military unit) is a republican state institution that is an organizationally independent unit of the Armed Forces, other troops and military formations of the Republic of Kazakhstan, to which a conditional and (or) valid name is assigned.

Chapter 1. Military personnel and their interrelations1. General rights, duties and responsibilities of military servicesgovernment of military personnel

     6. Military personnel enjoy all the rights and freedoms provided for by the Constitution and legislation of the Republic of Kazakhstan, subject to restrictions determined by the laws of the Republic of Kazakhstan.

     7. The use of their rights by military personnel should not prejudice the rights and legitimate interests of society, the State, military service, and the rights of other military personnel and citizens.

     8. The State guarantees the realization of the rights and freedoms, as well as the social and legal protection of military personnel, and the improvement of conditions of service and life.

     Ensuring and protecting the rights of military personnel are entrusted to commanders (chiefs) and military management bodies.

     Prior to taking the military oath, a serviceman may not be involved in combat missions (participation in combat operations, combat duty, combat and guard services); weapons and military equipment may not be assigned to a serviceman, and disciplinary action may not be imposed on him.

     Commanders (chiefs) guilty of non-fulfillment of duties to implement the rights, freedoms and legitimate interests of military personnel bear responsibility established by the laws of the Republic of Kazakhstan.

     9. Military personnel have the right to:

     1) to provide monetary allowances at the expense of budgetary funds on the basis of a unified system of remuneration for employees of bodies of the Republic of Kazakhstan maintained at the expense of the state budget, approved by the Government of the Republic of Kazakhstan in coordination with the President of the Republic of Kazakhstan, in accordance with the procedure provided for by the first heads of authorized bodies;

     2) to provide clothing and other types of property at the expense of budgetary funds in accordance with the standards approved by the first heads of authorized state bodies in coordination with the central authorized body for budget planning.;

     3) for promotion based on qualifications, abilities, and the conscientious performance of their official duties.;

     4) to appeal against their decisions and actions (inaction) to higher officials, as well as to the court in accordance with the procedure established by the laws of the Republic of Kazakhstan.;

     5) in agreement with an authorized official, enroll in military and special educational institutions, undergo course training, vocational training, retraining and advanced training, as well as enter non-military specialties (except for conscripts, cadets and cadets) in educational organizations that implement training programs for technical and vocational, post-secondary, higher education and postgraduate education, in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     6) for health protection and conditions of service that meet the requirements of safety and hygiene;

     7) compensation for damage caused to life and health or personal property during the performance of military service duties, in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     8) to provide housing during military service in accordance with the legislation of the Republic of Kazakhstan;

     9) for the storage, carrying and use of special means and weapons in the performance of military service duties;

     10) to get acquainted with the documents defining their rights, official duties and special duties;

     11) to get acquainted with reviews of their official activities and other documents before entering them into their personal file, personal file materials (with the exception of special verification materials containing information constituting state secrets), as well as to attach their written explanations, other documents and materials to their personal file;

     12) to protect their personal data and their family members;

     13) for medical care and spa treatment;

     14) for pension provision and social protection;

     15) appropriate organizational, technical and sanitary conditions, taking into account the specifics of military service;

     16) on vacation;

     17) to carry out medical, pedagogical, scientific or other creative activities.

     Other rights of military personnel may be established by the laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan.

     Military reservists are not subject to sub-paragraphs 1), 8), 14) (regarding retirement benefits), 16) (regarding the provision of annual leave) and 17) of the first part of this paragraph.

     10. The rules for carrying weapons by military personnel are determined by general military regulations. As a last resort, military personnel have the right to use weapons personally or as part of a unit in the following cases::

     1) repelling an armed attack on protected military and civilian facilities, guards, premises and structures of military units (institutions);

     2) suppression of attempts to forcibly seize weapons and military equipment;

     3) protection of military personnel and civilians from attacks threatening their life or health, including from animal attacks, if it is impossible to protect them by other means and means.;

     4) the detention of a person who has committed a criminal offense, is offering armed resistance or is caught in the commission of a grave, especially grave crime, as well as an armed person who refuses to comply with legal requirements to surrender weapons, if it is impossible to overcome resistance by other means and means, detain the criminal or seize the weapon.;

     5) the release of hostages, seized protected facilities, structures and special (military) cargo;

     6) to prevent the escape from custody of persons in respect of whom a preventive measure has been chosen in the form of detention; those sentenced to imprisonment, as well as to prevent attempts to forcibly release them;

     7) Giving an alarm or calling for help;

     8) necessary defense and extreme necessity.

     Military personnel who are part of the guard have the right to use weapons in cases and in accordance with the procedure set out in the Charter of the Garrison and Guard Services of the Armed Forces (hereinafter referred to as the Charter of the Garrison and Guard Services).

     The right to bear arms is confirmed by a corresponding mark in the identity card of the serviceman. In the ranks, weapons are carried according to the rules defined by the combat regulations.

     When carrying weapons outside the ranks, their safety and public safety must be ensured.

     When using weapons, a serviceman must not exceed the limits of necessary defense and extreme necessity.

     When a state of emergency is imposed and the Armed Forces are used to perform appropriate tasks, the provisions of the Law of the Republic of Kazakhstan "On the National Guard of the Republic of Kazakhstan" apply to military personnel in terms of the conditions, procedure and limits of the use of physical force, special means, service dogs, weapons, and the use of military equipment.

     When using the Armed Forces in carrying out tasks within the framework of an anti-terrorist operation, military personnel of the Armed Forces are subject to the provisions of the Law of the Republic of Kazakhstan "On National Security Agencies" regarding the conditions, procedure and limits of the use of physical force, special means, service dogs, weapons, and the use of military equipment.

11. The use of weapons should include a warning of the intention to use them, with the exception of a sudden armed attack, an attack using military equipment, vehicles, sea and river vessels, as well as escape from custody with weapons.

     When using and using weapons, a serviceman is obliged to take all possible measures to ensure the safety of surrounding citizens, and, if necessary, provide emergency medical assistance to victims.

     It is not allowed to use weapons against women and minors, except in cases where they commit an act of terrorism, an armed attack, provide armed resistance, or commit a group attack that threatens the life of a soldier or other persons, if it is impossible to repel such an attack by other means and means.

     The soldier reports to the commander (chief) about each case of the use or use of weapons.

General duties of military personnel

     12. The serviceman is obliged to:

     1) comply with the Constitution and other regulatory legal acts of the Republic of Kazakhstan, as well as the requirements of general military regulations;

     2) take the military oath in accordance with the established procedure, be faithful to it, selflessly serve your people, courageously and skillfully defend the Republic of Kazakhstan, perform military duty, and endure the hardships of military service.;

     3) be a patriot of his Homeland, strengthen the authority of state power by his actions, protect the interests of the state, and strengthen friendship between military personnel.;

     3-1) comply with the decision of the head of the authorized body on its rotation in accordance with the procedure and terms determined by the Rules of Military Service;

     4) be honest, disciplined, brave, and take reasonable initiative when performing military duty;

     5) to carry out the orders of the commanders (superiors) accurately and on time, to obey them implicitly and protect them in battle, to protect the Battle Flag of the military unit;

     6) constantly master military professional knowledge, improve their training and military skills;

     7) be able to use the weapons, weapons and military equipment entrusted to him, ensure their safety and proper operation;

     7-1) to ensure the safety of military property;

     8) cherish military camaraderie, rescue military personnel from danger, help them in word and deed, respect the honor and dignity of everyone, prevent rudeness and bullying against oneself and others, and deter them from unworthy actions;

     9) observe the rules of military courtesy, conduct and military greeting, while performing military service duties, wear military uniforms in compliance with the rules of wearing them, always and everywhere behave with dignity and honor;

     10) be vigilant and prevent the disclosure of state secrets;

     11) comply with the terms of the military service contract;

     12) participate in military units and subunits of the Armed Forces, united (coalition) armed forces in accordance with international treaties in armed conflicts;

     13) comply with the requirements and meet the standards for physical fitness approved by the heads of authorized bodies;

     14) comply with the standards of professional ethics established by the legislation of the Republic of Kazakhstan;

     15) accept the restrictions established by the laws of the Republic of Kazakhstan;

     16) submit a report in writing and immediately inform the commander (chief) in cases where the private interests of a serviceman overlap or conflict with his official powers.;

     17) to prevent public appearances that harm the interests of military service;

     18) immediately inform the commander (chief) in writing about:

     the intention to take citizenship of a foreign state;

     submitting an application for renunciation of citizenship of the Republic of Kazakhstan;

     the intention of the spouse or their close relatives to take citizenship of a foreign state and (or) their application for renunciation of citizenship of the Republic of Kazakhstan, if it became known to him;

     19) in case of dismissal from military service for negative reasons, an official discrepancy revealed by the results of attestation, in connection with the termination of citizenship of the Republic of Kazakhstan, reimburse the state in accordance with the procedure determined by the first head of the authorized state body.:

     the money spent on his education in a military or special educational institution, including in a foreign country, advanced training, course training, retraining in military-technical and other specialties;

     money equivalent to the amount of the concluded agreement between the Republic of Kazakhstan and the country of study.

     A serviceman undergoing military service under a contract, within thirty calendar days from the date of admission to military service, is obliged, for the period of military service, to transfer to trust management property belonging to him by right of ownership or other property right, the use of which entails income, with the exception of money, bonds, shares of open and interval mutual funds, shares of commercial organizations (common shares in the amount not exceeding five percent of the total number of voting shares of organizations), digital assets, legally owned by him, as well as property transferred to a property lease (lease), and submit a notarized copy of the property trust management agreement to the personnel service within the specified period. A serviceman undergoing military service under a contract has the right to lease (lease) a dwelling belonging to him by right of ownership and receive income from such rental, as well as receive income from property transferred to trust management and from other legitimate sources.

     The laws of the Republic of Kazakhstan may impose other duties on military personnel.

     12-1. A soldier must refrain from visiting a gambling establishment, except in cases related to the performance of official duties.

     13. A serviceman must honorably bear the high title of defender of the Republic of Kazakhstan, cherish the military glory of the Armed Forces and his military unit, and honor his military rank.

     14. A serviceman is obliged to respect state symbols and cherish the friendship of peoples.

     Military personnel should respect their national feelings, customs and traditions in their relationships.

     The language of work and office work in the Armed Forces is the state language, along with Kazakh, Russian is officially used.

     It is the duty of every serviceman to master the state language, which is the most important factor in consolidating the people of Kazakhstan.

     The commanders (chiefs) are obliged to develop the state language in every possible way, to create all the necessary organizational, material and technical conditions for the free and free mastery of the state language by all military personnel.
