Article 132-2. Agreement on the transfer of orphaned children, children left without parental care, to a foster family of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. An agreement on the transfer of orphaned children, children left without parental care, to a foster family must provide for the conditions of maintenance, upbringing and education of orphaned children, children left without parental care, the rights and obligations of foster parents, the duties of the body performing the functions of guardianship or guardianship, and the organization of education in which There were orphaned children, children left without parental care, in relation to foster parents, as well as the grounds and consequences of termination of such an agreement.
Orphaned children, children left without parental care, are transferred to foster parents for the period stipulated by the specified agreement.
A separate agreement is drawn up for each orphaned child, a child left without parental care, transferred to a foster family.
In the event of the expiration of the agreement on the transfer of orphaned children, children left without parental care, to a foster family, the extension of his stay in the family is carried out on the basis of a new agreement.
2. The procedure and amount of remuneration and cash payments to foster parents are determined by the legislation of the Republic of Kazakhstan.
3. Early termination of the agreement on the transfer of orphaned children, children left without parental care, to foster parents is possible:
1) at the initiative of the foster parents, if there are valid reasons (illness, change in marital or financial status, lack of mutual understanding with the child, conflict relations between children, etc.);
2) at the initiative of the body performing the functions of guardianship or guardianship, or an educational organization in which orphaned children, children left without parental care, were located, if unfavorable conditions arise for the maintenance, upbringing and education of orphaned children, children left without parental care;
3) in cases of the child's return to parents, other legal representatives in coordination with the body performing the functions of guardianship or guardianship, or the adoption of the child.
