Article 63. The right of a child to a name, patronymic and surname of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. A child has the right to a first name, patronymic and surname.
2. The child's name is given by the parents with their consent or by other legal representatives of the child. The patronymic, at the request of the parents or other legal representatives, is assigned by the name of the person indicated by his father.
It is allowed to assign a double name if written separately or separated by a hyphen, but no more than two names.
In the case of a father's double name, it is allowed to assign the patronymic to the child using the father's double name, one of them, or in the combined spelling of both father's names.
When a father changes his name, the patronymic of his minor child changes, and the patronymic of an adult child changes when he submits an application.
3. The surname of the child is determined by the surname of the parents. If the parents have different surnames, the child is assigned the surname of the father or mother by agreement of the parents.
At the request of the parents, the child's surname can be made on behalf of the child's father or grandfather, both on the father's and mother's sides, taking into account national traditions.
4. Disagreements that have arisen between the parents regarding the child's first and/or last name are resolved in court.
5. If paternity has not been established, the child's name is given at the direction of the mother, the patronymic is given by the name of the person recorded as the child's father, the surname is given by the mother's surname or, taking into account national traditions, by the name of the child's grandfather.
6. If both parents of the child are unknown, the last name, first name and patronymic of the child are assigned by the body performing the functions of guardianship or guardianship, medical or other organizations performing the functions of protecting the rights of the child at his location.
