Article 134. Agreement on the transfer of a child to foster care of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan

 1. An agreement on the transfer of a child to foster care must provide for the conditions of the child's maintenance, upbringing and education, the rights and duties of foster carers, the duties of the body performing guardianship or guardianship functions in relation to foster carers, as well as the grounds and consequences of termination of such an agreement.

The child is transferred to foster care by a foster carer for the period stipulated by the specified agreement.

A separate contract is drawn up for each child transferred to foster care.

In the event of the expiration of the contract for the transfer of a child to foster care, the extension of his stay in the family is carried out on the basis of a new contract.

2. The procedure and amount of remuneration and monetary payments to foster carers are determined by the legislation of the Republic of Kazakhstan.

3. Early termination of the agreement on the transfer of a child to foster care is possible.:

1) at the initiative of foster carers, if there are valid reasons (illness, change in marital or financial status, lack of mutual understanding with the child, conflict relations between children, etc.);

2) at the initiative of the body performing the functions of guardianship or guardianship, in the event of unfavorable conditions for the maintenance, upbringing and education of the child;

3) in cases of the child's return to parents, other legal representatives in coordination with the body performing the functions of guardianship or guardianship, or the adoption of the child.
