Article 57. The rights and obligations of the parties to the surrogacy agreement of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. When concluding a surrogacy agreement, the spouses (customers) must:
1) bear the material costs associated with the surrogate mother's medical examination;
2) bear the material costs associated with the use of assisted reproductive methods and technologies;
3) submit to medical organizations using assisted reproductive methods and technologies a medical report on physical and mental health, as well as the results of a medical and genetic examination;
4) to pay the medical expenses of the surrogate mother during pregnancy, childbirth and for fifty-six days after childbirth, and in case of complications related to pregnancy and childbirth, to pay the expenses for seventy days after childbirth.
2. In accordance with the requirements of Article 56, when concluding a surrogacy agreement, a surrogate mother must:
1) provide customers with a medical report on their physical, mental and reproductive health;
2) be regularly monitored by a doctor and strictly follow his recommendations and prescriptions;
3) inform the persons who have concluded a contract with her about the course of pregnancy with the frequency stipulated in the surrogacy contract;
4) transfer the born child to the persons who have concluded a surrogacy agreement with her.
3. The surrogate mother has no right to transfer the child to other persons.
4. If the surrogate mother has a permanent job, the issue of continuing her employment is resolved by mutual agreement of the parties to the surrogacy agreement.
5. The surrogate mother is responsible for pregnancy provided for in the surrogacy contract after the use of assisted reproductive methods and technologies, and is obliged to exclude the possibility of a natural pregnancy.
6. The issue of carrying multiple pregnancies is resolved by mutual agreement of the parties to the surrogacy agreement.
