Article 56. Requirements for a surrogate mother of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. A woman wishing to become a surrogate mother must be between the ages of twenty and thirty-five, have satisfactory physical, mental and reproductive health, confirmed by the conclusion of a medical organization, and also have a healthy child of her own.
2. If the surrogate mother is in a registered marriage (matrimony), when concluding a surrogacy agreement, the written consent of the spouse must be submitted, which must be notarized.
3. A medical organization using assisted reproductive methods and technologies is obliged to issue an opinion on their use with full and exhaustive information about the biomaterials used for this purpose by the persons wishing to have a child themselves or the donor bank.
One copy of the conclusion is attached to the notarized surrogacy agreement and is kept at the place of the transaction.
