Article 19. Dissolution of marriage (matrimony) by judicial procedure of the Code on Marriage (Matrimony) and Family of the Republic of Kazakhstan
1. The dissolution of a marriage (matrimony) in court is carried out if the court has established that further joint life of the spouses and the preservation of the family is impossible.
2. The dissolution of a marriage (matrimony) in court is carried out in the following cases::
1) the spouses have common minor children, with the exception of the cases provided for in paragraph 2 of Article 17 of this Code;
2) the lack of consent of one of the spouses to the dissolution of the marriage (matrimony);
3) if one of the spouses, despite the absence of objections, evades the dissolution of the marriage by his actions or omissions;
4) the existence of property and other claims of the spouses to each other.
3. The dissolution of a marriage (matrimony) in court is carried out after one month from the date of filing an application for dissolution of marriage (matrimony) with the court by the spouses.
4. In exceptional cases, the court may terminate the marriage (matrimony) before the expiration of the period specified in paragraph 3 of this article.
