Article 194. The procedure for assigning a surname, first name, patronymic to a child during the state registration of his birth of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. During the state registration of birth, the child's last name is determined by the parents' last name. If the parents have different surnames, the child is assigned the surname of the father or mother by agreement of the parents. At the request of the parents, the child's surname is made on behalf of the child's father or grandfather, taking into account national traditions. Disagreements that have arisen between the parents regarding the child's last name are resolved in court.
2. At the request of citizens, affixes unusual in the Kazakh language are excluded from use in writing surnames and patronymics of persons of Kazakh nationality: -ov, -ev, -ova, -eva, -in, -n, -iny, -na, -aries, -evna, -ovich, -evich, and instead of them in the patronymic are used: -uly, -kyzy in the combined spelling.
It is not allowed to write the surname of an individual with the addition of the words "tagi", "urpagy", "nemeresi", "shoberesi", "kelini" and others.
3. It is allowed to write the name of persons of Kazakh nationality in the order when the father's name replaces the surname, which necessarily comes first, then the first name, and the patronymic is written down at will.
In cases where the father's name replaces the surname with the addition of the endings -uly, -kyzy, the patronymic is not recorded.
4. For persons of other nationalities, if they wish, their surnames, first names and patronymics may be written in accordance with their national characteristics.
