Article 33. The common joint property of the spouses of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. The property acquired by the spouses during marriage (matrimony) is their common joint property.
2. The property acquired by the spouses during marriage (matrimony) includes the amounts of income of each spouse from work, entrepreneurial activity and the results of intellectual activity, the amounts of income from the common property of the spouses and the separate property of each spouse, pensions, benefits, pension savings received by them, with the exception of lump-sum pension payments from a single accumulative pension fund. fund for the purpose of improving living conditions and (or) paying for medical treatment, targeted savings and (or) payments of targeted savings from the unified accumulative pension fund for the purpose of improving housing conditions and (or) paying for education, as well as other monetary payments that do not have a special purpose (amounts of financial assistance, amounts paid to compensate for disability, injury or other damage to health, and others). The spouses' common property also includes movable and immovable property, securities, shares, deposits, shares in the authorized capital, contributed to credit organizations or other organizations, and any other property acquired by the spouses during marriage, regardless of whose name it belongs to in the family. purchased or one of the spouses deposited funds, including property, acquired through lump-sum pension payments and (or) payments of targeted savings from a single accumulative pension fund in order to improve housing conditions.
3. The right to the common property of the spouses also belongs to the spouse who, during the marriage (matrimony), carried out household management, took care of children, or for other valid reasons did not have an independent income.
