Article 64. Changing the name and (or) surname of a child of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. The surname of a minor child is changed when the surname is changed by both parents.
Upon the joint application of the parents, before the child reaches the age of sixteen, the registration authority, based on the interests of the child, authorizes the change of the child's name, as well as the surname assigned to him, to the surname of the other parent.
2. In case of termination of the marriage (matrimony) or recognition of the marriage (matrimony) as invalid, the child retains the surname he received at birth.
3. If the parents live separately, regardless of the state registration of the dissolution of marriage (matrimony), or paternity has been established for the child and the parent with whom the child lives wishes to give him his last name or change the last name after the father or grandfather of the child, both on the father's and mother's side, taking into account national traditions, the registering authority, depending on the interests of the child and taking into account the opinion of the other parent, notarized, amends the record of the state registration of the birth of a child.Consideration of the parent's opinion is not required if it is impossible to establish his location, deprive or restrict his parental rights, declare him incompetent, as well as in cases where the parent evades the maintenance and upbringing of the child without valid reasons.
4. Excluded by the Law of the Republic of Kazakhstan dated 07/14/2022 No. 141-VII (effective ten calendar days after the date of its first official publication).
5. If the child is born to persons who are not married to each other, and paternity has not been legally established, the registering authority, based on the interests of the child, authorizes the change of his last name to the last name of the mother, which she bears at the time of making such a request.
6. A change in the name and (or) surname of a child who has reached the age of ten years is made only with his consent, obtained in the presence of legal representatives.
